Man Killed In Plane Crash

According to the Monroe Sheriff’s Office, a man has been killed in a small plane crash off off Marathon in the Florida Keys. The plane, a 1973 single-engine Piper, crashed about a mile offshore of Marathon shortly after midnight. A man heard the crash and got into his boat to investigate. The Coast Guard and Florida Fish and Wildlife Conservation Commission also responded to the site and found the sunken wreckage. The pilot, Edward Elgin, 53, was found dead at the site of the crash. The crash is being investigated by the Federal Aviation Administration.

Can I Filed a Wrongful Death Suit as a Result of a Plane Crash?

If you have lost a loved one such as a parent, spouse or child in a plane crash, you may have grounds for a wrongful death suit. Wrongful death suits are similar to personal injury suits. However, rather than an injured person filing the suit against the negligent person who caused his or her injuries, the surviving family of a deceased person files a suit against the negligent party responsible for their loved one’s death. When filing a suit, you must determine who is actually responsible for the crash. Some common examples of those who may be legally responsible in an airplane crash include:
  • The pilots
  • The airline(s)
  • The owner of the aircraft
  • The manufacturer of the aircraft and its key parts
  • The aircraft maintenance provider
  • The government for possible negligence by air traffic controllers and weather services
  • Airport operators
The specific facts of the aviation case will determine who is responsible. When you determine who is responsible, you can file a suit against them. To win your suit, you must prove that the at-fault party acted negligently and that this negligence caused the crash. Aviation law can be complicated and cases involving plane crashes difficult to win. That is why you may need the help of a wrongful death attorney when you are facing this type of lawsuit.
