Hit-and-Run Leaves Child Injured

According to police, the search is currently underway for a driver who is responsible for causing a multi-vehicle crash that has left a child injured and in the hospital. The crash occurred on the Florida Turnpike on the northbound lands near the Pompano Beach rest stop. According to police, the crash involved three separate vehicles, one of which caused the accident then fled the scene. The injured child was taken by Air Rescue to Broward Health Medical Center while another victim was transported by ground to Broward Health North. Luckily, neither suffered life-threatening injuries.

The Florida Highway Patrol and Pompano Beach Fire Rescue are currently investigating the crash. They ask that anyone with information call Broward County Crime Stoppers at 954-493-TIPS. There is also a $3,000 reward for information leading to an arrest.

Can a Personal Injury Suit be Filed on Behalf of a Child?

Like adults, a child, or minor, has a right to compensation for injuries, pain and suffering and even permanent disability if he or she is injured in an accident caused by the negligence of another person. The child’s parents may also have a separate right to be compensated for medical bills paid on behalf of the injured child.

Being a minor in the eyes of the law, a child cannot negotiate a personal injury claim and settlement. In cases involving children, a parent or guardian is permitted to file and negotiate on behalf of the child. Because personal injury cases can be extremely complicated, it is in your and your child’s best interests to have a skilled personal injury attorney on your side.

Your attorney will help you determine the amount of compensation you should seek as well as the evidence needed to support your claim. Once this information has been submitted, it is likely the insurance company will attempt to negotiate a settlement with you. If they do not, you and your personal injury attorney can take the case to court to have a judge or jury decide. Insurance companies typically want to avoid going to court, especially in cases involving children. They are more likely to settle out of court. However, to ensure you receive a fair settlement, never agree to anything without having your attorney review it.

The team at Bernstein & Maryanoff in Miami have helped countless victims of personal injury, both old and young, seek compensation from at-fault and negligent drivers. Let us help you seek a fair settlement today.
